MESAFELİ SATIŞ SÖZLEŞMESİ

1. TARAFLAR
İşbu Sözleşme, aşağıdaki taraflar arasında belirtilen hüküm ve şartlar çerçevesinde kurulmuştur.

İşbu sözleşmeyi kabul etmekle ALICI, sözleşme konusu siparişi onayladığı takdirde sipariş konusu bedeli ve varsa kargo ücreti, vergi gibi belirtilen ek ücretleri ödeme yükümlülüğü altına gireceğini ve bu konuda bilgilendirildiğini peşinen kabul eder.

2. TANIMLAR
İşbu sözleşmenin uygulanmasında ve yorumlanmasında aşağıda yazılı terimler karşılarında belirtilen anlamları ifade eder.  

BAKAN: Ticaret Bakanı'nı,

KANUN: 6502 sayılı Tüketicinin Korunması Hakkında Kanun'u,  

YÖNETMELİK: Mesafeli Sözleşmeler Yönetmeliği'ni,  

HİZMET: Bir ücret veya menfaat karşılığında yapılan ya da yapılması taahhüt edilen mal sağlama dışındaki her türlü tüketici işlemini,  

SATICI: Ticari veya mesleki faaliyetleri kapsamında tüketiciye mal sunan veya mal sunan adına ya da hesabına hareket eden gerçek veya tüzel kişiyi,  

ALICI: Bir mal veya hizmeti ticari veya mesleki olmayan amaçlarla edinen, kullanan veya yararlanan gerçek ya da tüzel kişiyi,  

SİTE: SATICI'ya ait internet sitesini,

SİPARİŞ VEREN: Bir mal veya hizmeti SATICI'ya ait internet sitesi üzerinden talep eden gerçek ya da tüzel kişiyi,

TARAFLAR: SATICI ve ALICI'yı,  

SÖZLEŞME: SATICI ve ALICI arasında kurulan işbu sözleşmeyi,  

MAL: Alışverişe konu taşınır eşyayı ve elektronik ortamda kullanılmak üzere hazırlanan yazılım, ses, görüntü ve benzeri gayri maddi malları ifade eder.  

3. KONU
İşbu Sözleşme, ALICI'nın SATICI'ya ait internet sitesi üzerinden elektronik ortamda siparişini verdiği, nitelikleri ve satış fiyatı belirtilen ürünün satışı ve teslimiyle ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerini düzenler.
Listelenen ve sitede ilan edilen fiyatlar satış fiyatıdır. İlan edilen fiyatlar ve vaatler güncellenene veya değiştirilene kadar geçerlidir. Süreli olarak ilan edilen fiyatlar ise belirtilen süre sonuna kadar geçerlidir.

7. SÖZLEŞME KONUSU ÜRÜN/ÜRÜNLER BİLGİLERİ
7.1. Temel Özellikler
Malın, ürünün, ürünlerin veya hizmetin temel özellikleri; türü, miktarı, marka/modeli, rengi ve adediyle birlikte SATICI'ya ait internet sitesinde yayımlanır. SATICI tarafından kampanya düzenlenmişse ilgili ürünün temel özellikleri kampanya süresince incelenebilir.

7.2. Fiyatlar
Listelenen ve sitede ilan edilen fiyatlar satış fiyatıdır. İlan edilen fiyatlar ve vaatler güncellenene veya değiştirilene kadar geçerlidir. Süreli olarak ilan edilen fiyatlar ise belirtilen süre sonuna kadar geçerlidir.

7.3. Vergiler ve Ödemeler
Sözleşme konusu mal veya hizmetin tüm vergiler dâhil satış fiyatı sipariş onay ekranında gösterilmektedir.

9. GENEL HÜKÜMLER
9.1. Bilgilendirme ve Kabul
ALICI, SATICI'ya ait internet sitesinde sözleşme konusu ürünün temel nitelikleri, satış fiyatı ve ödeme şekliyle teslimata ilişkin ön bilgileri okuyup bilgi sahibi olduğunu ve elektronik ortamda gerekli teyidi verdiğini kabul, beyan ve taahhüt eder.

9.2. Teslim Süresi
Sözleşme konusu her bir ürün, 30 günlük yasal süreyi aşmamak kaydıyla ALICI'nın yerleşim yeri uzaklığına bağlı olarak internet sitesindeki ön bilgiler kısmında belirtilen süre içinde teslim edilir.

10. CAYMA HAKKI
ALICI, mesafeli sözleşmenin mal satışına ilişkin olması durumunda, ürünün kendisine veya gösterdiği adresteki kişi ya da kuruluşa teslim tarihinden itibaren 14 gün içinde SATICI'ya bildirmek şartıyla, hiçbir gerekçe göstermeksizin malı reddederek sözleşmeden cayma hakkını kullanabilir.  

11. CAYMA HAKKI KULLANILAMAYACAK ÜRÜNLER
ALICI'nın isteği veya açıkça kişisel ihtiyaçları doğrultusunda hazırlanan, iade edilmesi sağlık ve hijyen açısından uygun olmayan ve tesliminden sonra ambalaj, bant, mühür veya paket gibi koruyucu unsurları açılmış olan ürünler ile yürürlükteki mevzuatta belirtilen diğer mal ve hizmetlerde cayma hakkı kullanılamayabilir. Kozmetik ve Kişisel Bakım Ürünleri Özel Hükmü: Mevzuat gereği, cilt bakımı ve kozmetik ürünlerinde cayma hakkının kullanılabilmesi için ürünün ambalajının açılmamış, koruma bandının yırtılmamış ve ürünün kesinlikle kullanılmamış/denenmemiş olması şarttır. Bu şartları sağlamayan ürünlerin iadesi yasal olarak kabul edilmemektedir.  

12. TEMERRÜT HÂLİ VE HUKUKÎ SONUÇLARI
ALICI, ödeme işlemlerini kredi kartıyla yaptığı durumda temerrüde düştüğü takdirde, kart sahibi banka ile arasındaki kredi kartı sözleşmesi çerçevesinde faiz ödeyeceğini ve bankaya karşı sorumlu olacağını kabul, beyan ve taahhüt eder.

13. YETKİLİ MERCİLER
İşbu sözleşmeden doğan tüketici uyuşmazlıklarında, yürürlükteki mevzuat uyarınca yetkili tüketici hakem heyetlerine veya tüketici mahkemelerine başvurulabilir.  

14. YÜRÜRLÜK
ALICI, Site üzerinden verdiği siparişe ait ödemeyi gerçekleştirdiğinde işbu sözleşmenin tüm şartlarını kabul etmiş sayılır.

Distance Selling Agreement

1. PARTIES
This Agreement is established between the following parties within the framework of the terms and conditions specified below.

By accepting this agreement, the BUYER acknowledges in advance that if they approve the order subject to this contract, they will be under the obligation to pay the order price and any specified additional fees such as shipping fees and taxes, and that they have been informed about this.

2. DEFINITIONS
In the implementation and interpretation of this contract, the terms written below express the meanings indicated opposite them.

REGULATION: The Distance Contracts Regulation,

SERVICE: Any consumer transaction other than providing goods made or promised to be made in return for a fee or benefit,

SELLER: The real or legal person offering goods to the consumer within the scope of commercial or professional activities or acting on behalf of or for the account of the one offering goods,

BUYER: The real or legal person acquiring, using, or benefiting from a good or service for commercial or non-professional purposes,

SITE: The website belonging to the SELLER,

ORDERER: The real or legal person requesting a good or service through the website belonging to the SELLER,

PARTIES: The SELLER and the BUYER,

CONTRACT: This agreement concluded between the SELLER and the BUYER,

GOODS: Refers to movable property subject to shopping and software, audio, video, and similar intangible goods prepared for use in an electronic environment.

3. SUBJECT
This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts regarding the sale and delivery of the product, the qualifications and sales price of which are specified, ordered by the BUYER electronically via the SELLER's website.
The prices listed and announced on the site are the sales prices. Announced prices and promises are valid until updated or changed. Prices announced for a specific period remain valid until the end of the specified period.

7. CONTRACT PRODUCT/PRODUCTS INFORMATION
7.1. Basic Features
The basic features of the goods, product, products, or service; its type, quantity, brand/model, color, and amount are published on the SELLER's website. If a campaign is organized by the SELLER, the basic features of the relevant product can be reviewed during the campaign.

7.2. Prices
The prices listed and announced on the site are the sales prices. Announced prices and promises are valid until updated or changed. Prices announced for a specific period remain valid until the end of the specified period.

7.3. Taxes and Payments
The total sales price of the goods or services subject to the contract, including all taxes, is shown on the order confirmation screen.

9. GENERAL PROVISIONS
9.1. Information and Acceptance
The BUYER accepts, declares, and undertakes that they have read and become informed about the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the contract on the SELLER's website, and has provided the necessary confirmation in the electronic environment.

9.2. Delivery Time
Each product subject to the contract is delivered within the period indicated in the preliminary information section on the website, depending on the distance of the BUYER's settlement, provided that it does not exceed the legal 30-day period.

10. RIGHT OF WITHDRAWAL
In the event that the distance contract relates to the sale of goods, the BUYER may use the right to withdraw from the contract by rejecting the goods without any legal and penal liability and without stating any reason within 14 days from the date of delivery of the product to themselves or the person/organization at the address indicated, provided that they notify the SELLER.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised for products prepared in line with the BUYER's request or strictly for personal needs, products that are unsuitable for return due to health and hygiene reasons, and products whose protective elements such as packaging, tape, seal, or package have been opened after delivery, as well as other goods and services specified in the applicable legislation. Special Provision for Cosmetic and Personal Care Products: According to the regulations, in order to use the right of withdrawal for skincare and cosmetic products, the packaging of the product must be unopened, the protective tape must not be torn, and the product must be completely unused/untried. Returns of products that do not meet these conditions are not legally accepted.

12. DEFAULT STATE AND LEGAL CONSEQUENCES
The BUYER accepts, declares, and undertakes that if they default on their payment transactions made by credit card, they will pay interest within the framework of the credit card agreement between them and the cardholder bank and will be liable to the bank.

13. COMPETENT AUTHORITIES
In consumer disputes arising from this contract, applications can be made to the authorized consumer arbitration committees or consumer courts in accordance with the applicable legislation.

14. EFFECTIVENESS
The BUYER is deemed to have accepted all the terms of this contract when they make the payment for the order placed through the Site.
